OFFICIAL RULES
1. ELIGIBILITY
VOID WHERE PROHIBITED. NO PURCHASE NECESSARY. The Sweepstakes is open to legal
residents of the United States. You must be at least 18 years of age to enter.
Employees, officers, directors, shareholders, agents, representatives, and
immediate family members of Sponsors and their respective parent companies,
affiliates and subsidiaries are not eligible to participate in this Sweepstakes.
2. HOW TO
ENTER
All guests of the Mount View Hotel & Spa participating in any of these
packages (Midweek Stay and Spa, Oh Baby, Deserve It Housewives, or Where the
Boys Aren’t) during the months of April and May will be automatically
entered in our sweepstakes.
Entry by Mail: Please send us a standard index card with your full name, mailing
address, email address and valid phone number to Mount View Hotel & Spa
Sweepstakes 1457 Lincoln Ave. Calistoga CA 94515.
Limit one entry per household address during the entire Sweepstakes. If multiple
entries are received from any person or e-mail address, all such subsequent
entries will be disqualified.
Prizewinners will be selected from a random drawing held from all eligible
entries received. Sweepstakes promoters and/or sponsors are not responsible
for lost or stolen entries.
Sweepstakes entries will be disqualified, at the sole discretion of the Mount
View Hotel & Spa, if attempts are made to disrupt the Sweepstakes or circumvent
the terms and conditions of these Official Rules. If the above occurs, Mount
View Hotel & Spa reserves the right to remedy any such action, disruption,
or circumvention in a manner, determined solely by, that is fair and equitable
to Sweepstakes participants.
3. PRIZES
The Sweepstakes Prizes are not transferable or assignable and they are not
redeemable for cash, except that the Sponsors reserve the right to substitute
a prize of equal or greater value if the prize is unavailable. All winners
are responsible for the payment of any and all taxes and/or licenses and/or
other related local, State, Federal fees that may apply to such winnings.
Taxes on prizes are solely the responsibility of the winners.
Odds of winning depend on the number of eligible entries received, according
to the eligibility requirements in this promotion. Winners will be selected
by random drawing from among all eligible entries received. Limit one (1)
prize per winner. Winners will be notified by e-mail or telephone. Winners
will have up to five (5) days from the date of attempted notification to respond
to the notification. Sponsors are not responsible for and shall not be liable
for late, lost, misdirected, or unsuccessful efforts to notify winners. Unless
prohibited by law, winners may be required to complete and return an affidavit
of eligibility and a publicity/liability release within five (5) days of responding
to the notification. Each winner may also be required to provide Mount View
Hotel & Spa with proof that he or she is the authorized tenant or owner
of the mailing address associated with the winning entry. If a selected winner
cannot be contacted, is ineligible, fails to claim a prize, or fails to return
a completed and executed affidavit and release as required, an alternate winner
may be selected. Each winner consents to the use of his or her name and likeness
for publicity and commercial purposes without further compensation unless
prohibited by law.
4. CONDITIONS
By entering, participants agree to be bound by these complete Official Rules
and the decisions of the Mount View Hotel & Spa, which shall be final.
All federal, state, and local laws apply. Sponsor and their employees, officers,
directors, shareholders, agents, and representatives and their parent companies,
affiliates, subsidiaries, and advertising, promotion and legal advisors are
not responsible for and shall not be liable for: (i) late, lost, delayed,
damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii)
any condition caused by events beyond the control of the Mount View Hotel
& Spa that may cause the Sweepstakes to be disrupted or corrupted; (iii)
any injuries, losses, or damages of any kind caused by a prize or resulting
from acceptance, possession, or use of a prize, or from participation in the
Sweepstakes; or (iv) any printing or typographical errors in any materials
associated with the Sweepstakes. In addition, by entering the contest, participants
acknowledge that the Mount View Hotel & Spa may share all contest registration
information, as it deems proper. Delivery of prizes can take up to 4 to 6
weeks.
Sponsor is not responsible for postal mistakes that are human or technical
in nature. Entries become the property of the Sponsor and will not be returned.
This Sweepstakes shall be governed by California law. By participating in
this contest, entrants agree that California courts shall have jurisdiction
over any dispute or litigation arising from or relating to this Sweepstakes
and that venue shall be only in Napa County.
The Mount View Hotel & Spa may prohibit you from participating in the
Sweepstakes, if at the sole discretion of the Mount View Hotel & Spa,
you repeatedly show a disregard for the these Sweepstakes Official Rules,
or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse,
threaten, or harass any other player or a representative of any Sponsor; or
(3) in any other disruptive manner.
Mailed entries will be deemed to have been submitted by the authorized occupant
of the mailing address submitted at the time of entry.
To receive a copy of the Official Rules, or an Official Winners List, send
a self-addressed stamped envelope to: Spa Lover’s Season Sweepstakes
Rules c/o Andrea DeTrinidad, 1457 Lincoln Ave. Calistoga CA 94515. Specify
winner's list or rules on your request as well as Sweepstakes you are inquiring
about. Replies will be sent after the completion of the Sweepstakes. Winners
list requests must be received within 1 month of completion of the Sweepstakes.
